The U.S Supreme Court should decide Thursday whether to uphold two lower court rulings declaring the state’s nitrogen gas execution protocols cruel and unusual punishment and allow it to carry out a death sentence.

The courts found that the execution method would subject Jeffery Lee, scheduled to be put to death Thursday for the murders of two people during a pawn shop robbery in 1998, to mental distress “over and above” what was constitutionally permitted. …
