If a landlord sues a tenant for not paying their rent, the tenant must pay their missed rent up front while they defend themselves in court. House Bill 281 by Del. Katrina Callsen, D-Albemarle, would remove that requirement for tenants who withhold their rent due to a landlord’s failure to remedy critical maintenance issues or unlivable conditions that threaten the health and safety of residents.
